TERMS

PaceCommand terms of service

These terms govern use of PaceCommand, operated by BP Labs LLC. Please read them before creating or activating an account.

Agreement and operator

By affirmatively accepting these Terms when you register or activate your account, you enter an agreement with BP Labs LLC ("BP Labs", "we", "us"). Our Privacy Policy explains personal-data practices and is not a waiver of privacy rights. If you use PaceCommand for a school, team, or other organization, you represent that you have permission to act for it only to the extent you actually have that authority. These Terms apply alongside any separately signed agreement; a signed agreement controls if there is a conflict.

Eligibility, minors and school authorization

Account holders must be at least 13 years old. Do not create accounts for children under 13 or use a guardian account to bypass this limit. A minor should use PaceCommand with any consent required by law and their school or organization. Coaches and organizations must be authorized to collect and share athlete information, provide required notices, and obtain legally required guardian, school or student permissions. School deployment may require a separate student-data or data-processing agreement; access to this app alone does not establish FERPA or other school-law compliance.

Accounts, roles and acceptable use

Protect your credentials, maintain accurate contact information, and access only records you are authorized to use. Head coaches control invitations and assigned access; assistant, athlete and guardian roles have limited permissions. Guardian accounts are intended for an authorized adult and are view-only. You may not impersonate others, invade privacy, unlawfully share school or athlete records, circumvent permissions, probe security, scrape private data, upload unlawful material, or interfere with the service. Notify support promptly if your account is compromised.

Coaching, safety and data accuracy

PaceCommand organizes workouts, calculates estimated targets, records results and may display wellness or readiness information. Estimates, splits, summaries, imported exercise records and notifications can be incomplete, delayed or inaccurate. The service does not prescribe training or provide diagnosis, treatment, emergency monitoring or medical care. Coaches and participants remain responsible for exercise safety, supervision, reviewing information and making individualized decisions. Do not rely on a workout-opening confirmation or message delivery status as proof that someone has read or understood an instruction.

Team information and content rights

You and your organization retain whatever rights you have in workouts, results, photos, notes and other content you submit. You grant BP Labs a limited, nonexclusive license to host, process, display, back up and transmit that content solely to provide, secure, maintain and support PaceCommand as described in the Privacy Policy. You represent that you have rights and permissions needed to supply and share the content. You must not upload protected medical, student or third-party information unless your organization has a lawful basis and any required agreement. Team-owned history may remain with a program when an individual member leaves or deletes a login, as explained in the Privacy Policy. BP Labs retains rights to the software, logos, designs and documentation; these Terms do not transfer intellectual property to you.

Optional Apple Health data

Where available, an athlete must choose whether to import completed runs and whether selected copies may be shared with the team. Imported activity may be accessible to authorized coaches and linked guardians, as explained in the Privacy Policy. Import is optional and not necessary to use the primary coaching features. Never use imported workout data for unauthorized advertising or unrelated profiling.

Subscriptions, trials and billing

New teams may evaluate the app for 14 days without a credit card. Existing approved beta teams retain their individually communicated complimentary access terms. Paid team plans are optional and begin only when an authorized Head Coach completes Stripe Checkout; leaving a trial or free beta does not automatically create a charge. Before purchase, checkout presents the actual price, billing interval, applicable taxes and total. Paid plans renew on the disclosed monthly or annual schedule unless canceled. An authorized billing owner can manage payment details and cancel future renewal through the Stripe billing portal. Cancellation ordinarily preserves paid access until the end of the current term; team history may remain viewable when paid editing ends. Founding-coach discounts and eligibility are shown at checkout and must not be assumed unless confirmed there.

Refunds and plan changes

Payments generally are nonrefundable, including unused time, except where applicable law requires a refund or another right. Eligible upgrades are voluntary, with applicable prorations and additional charges shown before confirmation. Plan downgrades are not offered as a standard option; exceptional-circumstance requests may be reviewed individually and approval is not guaranteed. Canceling a renewal does not itself delete an account. You retain all statutory cancellation, refund and consumer rights that cannot lawfully be excluded.

Availability and warranty disclaimer

To the maximum extent permitted by applicable law, PaceCommand is provided "as is" and "as available" without implied warranties of merchantability, fitness for a particular purpose, noninfringement or uninterrupted availability. We do not promise error-free calculation, a particular athletic outcome, permanent feature availability, data recovery or uninterrupted access. This paragraph does not affect warranties, rights or remedies that cannot lawfully be disclaimed.

Limits on liability

To the maximum extent permitted by law, BP Labs LLC and its service providers will not be liable for indirect, incidental, special, exemplary or consequential damages, including lost profits or lost opportunities, arising from the service. To the maximum extent permitted by law, BP Labs LLC's aggregate liability for claims arising from PaceCommand is limited to the greater of US $100 or the amount paid for PaceCommand by the claimant or their organization during the 12 months preceding the event giving rise to the claim. These limits do not apply to liability that applicable law does not permit us to exclude or restrict, including liability for intentional misconduct, fraud, certain personal injury claims or nonwaivable statutory and privacy rights. Nothing here limits remedies that the law guarantees.

Responsibility for unauthorized organizational content

To the extent permitted by law, an adult acting on behalf of a team or organization agrees to defend and indemnify BP Labs LLC against third-party claims and reasonable documented costs arising from that adult's or organization's unlawful disclosure of athlete or third-party information, infringement by content it supplies, or willful violation of these Terms, except to the extent caused by BP Labs' own conduct. We will provide reasonably prompt notice and an opportunity to participate in the defense. This provision does not apply to minors or restrict a user's nonwaivable rights or good-faith privacy complaints.

Suspension, ending access and data

You may stop using the service and request account deletion using account deletion. We may suspend or restrict access when reasonably necessary to respond to security risks, illegal conduct, serious rule violations, nonpayment of an elected subscription or threats to other users. We will provide notice and an opportunity to resolve the issue when reasonable and lawful, but urgent risks may require immediate action. Suspending an account does not erase an organization's legitimate shared records; deletion, retention, cancellation and export are handled under the Privacy Policy and any applicable signed agreement. Legally required refunds and data rights remain available.

Third-party services and intellectual property complaints

Payment providers, app stores and optional device integrations may have separate terms. We cannot control their availability. Do not upload content that infringes rights. Report suspected infringement or misuse to accounts@bplabsllc.com with enough information to identify the material and the rights you believe are affected; do not send passwords or unnecessary athlete details.

Disputes and governing law

Before filing a nonurgent contractual claim, please contact support so we can attempt an informal resolution within 30 days. These Terms are governed by the laws of Utah, United States, without regard to conflict-of-law rules, to the extent permitted by applicable law. For disputes involving business or organizational accounts, courts located in Utah have jurisdiction to the extent permitted by law. Consumers may pursue claims in courts or forums available under mandatory local law. We do not require mandatory arbitration or waive class-action rights in these Terms. Nothing here restricts regulatory complaints, urgent legal relief or rights that cannot lawfully be waived.

Changes, severability and contact

We may update these Terms for product, operational or legal changes. We will identify the updated version and provide notice or request renewed agreement when required. Material changes will not be imposed retroactively where the law requires affirmative consent. If a provision is unenforceable, the remaining provisions continue to the extent lawful. The provisions concerning intellectual property, responsibility for content, liability, lawful retention and dispute resolution survive account closure when applicable.
